According to Miragenews, the South Australian state government recently announced that in order to protect public health, it will implement new measures to ban smoking and e-cigarettes in public places. These measures will be implemented simultaneously with national reforms to restrict e-cigarettes, which will ban the import of disposable e-cigarettes from January 1, 2024.
From March 1, 2024, the South Australian government stipulates that individuals smoking or using e-cigarettes in outdoor public places will face a fine of AUD 105, and serious offenders can be prosecuted and fined up to AUD 750. These no-smoking areas include:
Patrol flag areas and within 50 meters of beaches and piers within 5 meters
Schools and nurseries and within 10 meters
Entrances to and within 10 meters of non-residential buildings, such as shopping malls, government and commercial buildings
Public hospitals and medical institutions, private hospitals and their boundaries within 10 meters
Outdoor public swimming facilities
Major event venues declared under the Major Events Act 2013
Playing and viewing areas during under-18 sporting events and within 10 meters of them
To educate the community about these new bans, the South Australian Government will run ads on social media, radio, billboards, buses and shopping malls from January 28.
The South Australian government also proposes dual penalties for selling or supplying tobacco and e-cigarette products to children, with fines increasing from A$1,200 to A$2,400, and increasing the maximum prosecution fine for first-time offenses for tobacco or e-cigarette companies from A$20,000 to A$40,000. Australian dollars, with the maximum individual prosecution fine increased from A$5,000 to A$10,000.
